Welcome to Wowky Games. These Terms of Service ("Terms") govern your use of all mobile games, PC games, applications, and related services (collectively, the "Services") developed and published by Wowky Games LLC (hereinafter referred to as "Wowky Games", "we", "us", or "our").

 

1. Acceptance of Terms

By downloading, installing, accessing, or playing our Services, or by tapping "Play" (or equivalent) in our games, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

 

2. Age Requirements

You must be at least 13 years old to access and use our Services. If you are between the ages of 13 and the age of legal majority in your jurisdiction, you must have the permission of your parent or legal guardian to use the Services, and they must agree to these Terms on your behalf.

 

3. User-Generated Content and Local Customization

Local Processing: Certain features in our Services may allow you to import images from your device's gallery to customize characters or game elements during an active gameplay session. You acknowledge and agree that these images are processed locally on your device, stored only in temporary memory (RAM), and are not uploaded to, stored on, or transmitted through Wowky Games servers. All imported images are discarded after the session ends.

 

Responsibility for Content: You are solely responsible for any images or content you import into the game. You represent and warrant that you have all necessary rights to use such content and that it does not violate any third-party rights.

 

Social Sharing at Your Own Risk: If you choose to capture screenshots, record videos, or otherwise share gameplay featuring your locally customized characters on third-party platforms or social media, you do so entirely at your own risk. Wowky Games assumes no responsibility or liability for any copyright strikes, DMCA takedown notices, or other claims arising from the content you choose to display and share.

 

4. Virtual Currency and In-App Purchases (IAP)

License, Not Ownership: Our Services may include virtual currency (e.g., coins, gems) or virtual items. You acknowledge that you do not "own" these items. Instead, you receive a limited, personal, non-transferable, and revocable license to use them within the Services. Virtual items and currency have no real-world monetary value and cannot be exchanged for real money.
 

No Refunds: All purchases of virtual currency and virtual items are final and non-refundable, except as required by applicable law or the respective platform policies (e.g., Apple App Store, Google Play).

 

5. Code of Conduct

While using the Services, you agree not to:

• Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software designed to modify or interfere with the game experience.

• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Services.

• Use the Services for any commercial purpose without explicit written consent from Wowky Games.

 

6. Intellectual Property

All rights, title, and interest in and to all games developed and published by Wowky Games (excluding your locally imported images), including but not limited to the underlying code, UI/UX design, audio, graphics, original characters, and overarching intellectual property such as the Uanamon universe and brand, are exclusively owned by Wowky Games. You may not copy, distribute, modify, or create derivative works of our Services or IP without our express permission.

 

7. Limitation of Liability

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Wowky Games makes no warranties, express or implied, that the Services will be uninterrupted, error-free, or secure. To the maximum extent permitted by law, Wowky Games shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Services.

 

8. Right to Terminate

We reserve the right to suspend or terminate your access to the Services, or ban your account, at any time and for any reason, including but not limited to a violation of these Terms, without prior notice or liability.

 

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ukraine.

 

10. Controlling Language

These Terms of Service are originally written in English. In the event of any conflict, discrepancy, or inconsistency between the English version and any translated version of these Terms, the English version shall prevail and act as the legally binding agreement.

 

11. Changes to Terms

We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website or within the Services. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
